On the one hand, SKW Schwarz advises its clients particularly on the licensing of content and its commercial rights (IP). This advice is provided both relating to platforms and to competitions such as individual tournaments and/or leagues – whether by third-party organizers or (gaming) publishers themselves. Our advice in this area focuses also on commercial exploitation through advertising, sponsoring, and merchandising as well as, owing to the growth of the sector, on M&A transactions.
On the other hand, we are increasingly advising our clients on regulatory issues relating to gaming law and broadcasting law, government permits, and licenses, the protection of minors, and financial regulatory requirements for virtual and digital currencies and objects.
Facing the challenges of this emerging sector, the joint establishment of (legal) industry standards in particular could also help to put a stop to the still relatively frequent unlicensed second-hand and third-hand exploitation of added value and provide a professional basis for the sector’s rapid growth.
Therefore, SKW Schwarz was organizing a major industry event for the first time in cooperation with Sport1 and the German eSport Federation (ESBD) in November 2019.
